1. Acceptance of terms

By creating an account, posting an advertisement, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy. These Terms form a binding agreement between you and OnaLabbak.

2. Eligibility and account registration

You must be at least 18 years of age and able to enter into a legally binding contract to use the Platform. When you register, you agree to provide accurate, current and complete information and to keep it up to date.

3. Your account and responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use. We are not liable for any loss arising from your failure to safeguard your account.

4. Posting ads and our review process

You are solely responsible for the advertisements and content you submit, including their accuracy, legality and quality. By posting, you confirm that you have the right to sell the item or offer the service and that your listing is truthful and not misleading.

Advertisements submitted to the Platform are reviewed before they are published. We may approve, edit, reject or remove any listing at our discretion — for example, where it breaches these Terms, contains prohibited content, or is incomplete or misleading. Submission of an ad does not guarantee that it will be published, and approval does not constitute our endorsement of the listing.

5. Prohibited items and content

You must not post advertisements for items or services that are illegal, restricted or otherwise prohibited. Prohibited content includes, without limitation:

• Illegal drugs, weapons, explosives and other restricted goods.
• Counterfeit, stolen or fraudulently obtained items.
• Adult or sexually explicit content and services.
• Live animals where prohibited by law, and protected wildlife.
• Items that infringe the intellectual property rights of others.
• Content that is defamatory, hateful, harassing or discriminatory.
• Misleading, fraudulent or deceptive offers and pricing.

6. Prohibited conduct

You agree that you will not:

• Use the Platform for any unlawful, fraudulent or harmful purpose.
• Post spam, duplicate listings or irrelevant content.
• Harass, threaten or abuse other users.
• Attempt to gain unauthorised access to the Platform or other accounts.
• Interfere with or disrupt the operation, security or integrity of the Platform.
• Scrape, harvest or collect data about other users without consent.

7. Content ownership and licence

You retain ownership of the content you submit. However, by posting content on the Platform, you grant OnaLabbak a non-exclusive, royalty-free, worldwide licence to host, store, display, reproduce and promote that content for the purpose of operating and marketing the Platform. You are responsible for ensuring you hold all necessary rights to grant this licence.

8. Marketplace disclaimer

OnaLabbak is a venue that allows users to post and respond to advertisements. We are not a party to any transaction between buyers and sellers, and we do not own, inspect, guarantee or take possession of the items advertised. We make no warranty as to the quality, safety, legality or accuracy of any listing. Any dealings you have with other users are solely between you and them, and you transact at your own risk.

9. Limitation of liability

To the fullest extent permitted by law, OnaLabbak and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising from your use of (or inability to use) the Platform or from any transaction or interaction with other users.

10. Indemnification

You agree to indemnify and hold harmless OnaLabbak from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your use of the Platform, your content, or your breach of these Terms or any applicable law.

11. Suspension and termination

We may suspend, restrict or terminate your access to the Platform — and remove any content — at any time and without prior notice, where we reasonably believe you have breached these Terms or where necessary to protect the Platform or its users. You may stop using the Platform and request deletion of your account at any time.

12. Intellectual property

The Platform, including its design, logos, trademarks, text and software, is owned by OnaLabbak or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute or create derivative works from any part of the Platform without our prior written permission.

13. Changes to these terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Platform after any change takes effect constitutes your acceptance of the revised Terms.

14. Governing law

These Terms are governed by and construed in accordance with the laws of Sri Lanka, and you agree to submit to the exclusive jurisdiction of the courts of Sri Lanka in respect of any dispute arising from or relating to these Terms or the Platform.
